Practice Areas

Personal Injury Law

At Allaben & Bandeen Attorneys at Law, we specialize in personal injury law. If you have been hurt due to a business owner or homeowner’s negligence, you are qualified to pursue a personal injury lawsuit. This includes slip and fall accidents, dog bites, car accidents, and more.

Wrongful Death

Unfortunately, wrongful deaths occur in situations where they could have been avoided. Due to a homeowner, business owner, or driver’s negligence, an accidental death could take place. Cases such as this are understandably emotional and heavy for the families and friends of the victim. It’s never a situation you thought you would be in.

We will take the time to listen to your concerns to create an outcome that is favorable for those left behind. When a life is taken, justice is merited for the family, friends, and community that were affected. It’s also imperative to create change so that another avoidable death doesn’t occur. Our attorneys will work tirelessly to achieve justice and compensation for the victim’s death.

Worker’s Compensation

Worker’s compensation protects employees from unsafe working conditions. Every industry has safety measures and regulations in place that need to be abided by. Riskier professions such as construction work and trucking have additional safety measures. However, sometimes the employers fall short and an employee could be injured or killed.

The Michigan Worker’s Disability Compensation Act governs worker’s compensation in the state. Due to the many revisions the act has undergone over the years, it has become more difficult for injured employees to pursue worker’s compensation claims. If you want to stand a chance in a worker’s comp situation, you need an experienced attorney on your side. Our team knows the ins and outs of the law and will provide you with your best chance at winning the compensation you deserve.

What should you do immediately after an accident?

First and foremost, seek medical attention if you need it. Otherwise, try not to have the scene tampered with and call us immediately. The sooner we can get on the case, the more accurate the evidence will be, and there will be a higher chance that the outcome will be in your favor.

What is the no-fault law?

If you are involved in an automobile accident and injured, you may be entitled to benefits according to Michigan’s No-Fault Law. This includes reimbursement for medical expenses, wage loss, replacement services, attendant care, and mileage reimbursement.

What do allowable expenses cover?

If you were involved in an automobile accident, allowable expenses will reimburse you for your medical costs associated with the accident.

Who is eligible for attendant care?

Benefits will be allowed to you if you need help with personal care to perform daily activities such as bathing, dressing, and eating.

What are wage loss benefits?

Wage loss benefits are 85% of any gross wages that were lost due to the accident up to a statutory monthly maximum that is adjusted each year.

What are replacement services?

Replacement services are where you are allotted $20/day for any service you can no longer do because of your injuries to go towards hiring someone or a family member to help you.

How do you receive mileage reimbursement?

Keep track of your mileage to the hospital and any doctor’s appointments related to the injuries sustained during the accident. Then you can submit these records to your auto insurance company to receive reimbursement periodically.

What is considered to be non-economic damages?

Non-economic damages include mental anguish, pain and suffering, fright, embarrassment, loss of enjoyment of life, denial of social pleases, and more. This is not easy to win because the No-Fault Law says that the person vying for non-economic damages must suffer death, serious impairment of body function, or serious and permanent disfigurement.

What is premises liability?

Premises liability says that the homeowner or business owner must maintain a safe premise to protect themselves and visitors. If you slip and fall on someone’s driveway, you may file a premises liability suit due to the homeowner’s negligence to keep their driveway safe.

What is the “Open and Obvious” rule?

Premise liability suits have become more difficult because the law now states that if the hazard was obvious and easy to discover, then you may not win the case.
